1. Your Acceptance
A. You must be legally able to accept the Terms of Service.
You affirm that you are either more than 16 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.
B. You must accept these terms to use Duck Ruckus.
By using Duck Ruckus, you, the user, signify your agreement to (1) these terms and conditions (the “Terms of Service”), (2) Duck Ruckus’s privacy policy, incorporated herein by reference (the “Duck Ruckus Privacy Policy”), and (3) Duck Ruckus Community Guidelines, incorporated herein by reference (the “Duck Ruckus Community Guidelines”), and any modifications thereto. If you do not agree to the Terms of Service, Privacy Policy, and Community Guidelines, (all listed on this page) then you are not permitted to use and/or visit Duck Ruckus.
C. By using Duck Ruckus you indicate to us that you agree to the Terms of Service. We will change these Terms of Service occasionally, so make sure you stay up to date.
These Terms of Service apply to all users of Duck Ruckus. Duck Ruckus reserves the right to amend these Terms of Service at any time. It is your responsibility to periodically review these Terms of Service for any such modifications. If you do not agree to changes, you may request the deletion your User Profile and Account.
2. We are not responsible for issues you have with third party websites and apps that Duck Ruckus participants link to.
Duck Ruckus may contain links to third party websites that are not owned or controlled by Duck Ruckus. Duck Ruckus is not affiliated with or responsible for any links or apps on this website. Duck Ruckus has no control over, and–except to the extent required by applicable law–assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Duck Ruckus will not and cannot censor or edit the content of any third party site. Accordingly, we encourage you to be aware when you leave Duck Ruckus and to read the terms and conditions and privacy policy of each other website or app that you visit. By using Duck Ruckus, you expressly relieve Duck Ruckus from any and all liability arising from your use of any third party website or mobile apps.
3. You are responsible for what happens through your account and we may hold you liable for losses resulting from improper use.
In order to access some features of Duck Ruckus, you will have to create a Duck Ruckus account and User Profile. You may never use another individual’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Duck Ruckus immediately of any breach of security or unauthorised use of your account. Although Duck Ruckus is not liable for your losses caused by any unauthorised use of your account, you may be liable for the losses of TechSavvy City or others due to such unauthorised use.
4. You are responsible for processing and protecting any personal information that you receive from another user or another individual.
You will pay us for any damages we suffer if you violate applicable privacy laws. As you use Duck Ruckus, you may receive or collect personal information as you interact with other people. You MUST protect this personal information with the utmost care and abide by privacy practices as set forth below. You may not use or disclose it for any purpose other than as allowed by the individual or by applicable law. You consent to the collection, processing, and transfer of all your information and customer information by Duck Ruckus as set forth in our Privacy Policy below. Duck Ruckus may process that personal information as needed for whichever activity it was given to us for. You can read about how we treat personal information in our Privacy Policy. As explained in Section 14 on indemnification, you agree to defend, indemnify and hold us harmless if you violate any applicable privacy laws. For purposes of the EU’s General Data Protection Regulation (“GDPR”), you, the user, are the data controller for any personal information you receive or collect through Duck Ruckus, and Duck Ruckus are data processors. This means that you are responsible under the GDPR for what happens to that personal information as it is processed by yourself, Duck Ruckus and any third parties you allow to process it.
5. Duck Ruckus User Contributions.
A. Your contributions
You may upload and/or may have uploaded all and every type of content to Duck Ruckus (the “User Contributions”). You represent and warrant that none of your User Contributions are illegal, obscene, threatening, defamatory, invasive of privacy, infringing of any intellectual property rights, injurious to third parties, or otherwise objectionable to Duck Ruckus in its sole discretion, including but not limited to any form of “spam” (as determined by Duck Ruckus in its sole discretion). Duck Ruckus does not provide for any confidentiality with respect to any User Contributions. Duck Ruckus reserves the right to remove or delete User Contributions without prior notice.
B. Don’t upload anything that isn’t yours without permission, especially personal information.
You shall not upload User Contributions containing material that is copyrighted, protected by trademark or trade secret, or otherwise subject to third party proprietary rights, including privacy and publicity rights, including privacy and publicity rights, unless you are the owner of such rights or have permissions from their rightful owner to post the material and to grant Duck Ruckus all of the licenses granted herein. Do not upload or post any personal information of another person without the express permission of the person it pertains to.
You shall be solely responsible for all of your User Contributions and the consequences of uploading them.
C. You own the rights to your User Contributions and give us the right to use them for their purposes in Duck Ruckus.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorise Duck Ruckus to use all patent, trademark, trade secret, copyright, and all other intellectual property rights or other proprietary rights in and to any and all User Contributions, to enable inclusion and use of the User Contributions in the manner contemplated by Duck Ruckus and these Terms of Service, such as displaying the User Submission in discussion forums. You grant Duck Ruckus the right to use your name and account username in connection with your User Contributions.
D. You still own your User Contributions, but you grant us a license to it.
You retain all of your ownership rights in your User Contributions. By uploading User Contributions to Duck Ruckus, you hereby grant Duck Ruckus a worldwide, non-exclusive, royalty-free, perpetual, sublicensable, and transferable license to use, reproduce, distribute, adapt, modify, prepare derivative works of, display, and perform the User Contributions in connection with Duck Ruckus, website extensions, and the business of Duck Ruckus and its successors and affiliates, including without limitation for promoting Duck Ruckus in any media formats and through any media channels.
E. You also grant other users a license to your User Contributions.
By uploading User Contributions to Duck Ruckus, you hereby grant each user of Duck Ruckus a non-exclusive license to access your User Contributions through Duck Ruckus, and to use, reproduce, distribute, display, and perform such User Contributions as permitted through the functionality of Duck Ruckus and under these Terms of Service.
F. We may keep deleted User Contributions.
You understand and agree that Duck Ruckus may retain, but not display, distribute, or perform, server copies of User Contributions that have been removed or deleted. Duck Ruckus does not often do this, and only with concerning material. See G.
G. Don’t upload anything illegal or against our rules.
You agree that you will not, in connection with User Contributions, submit material that is contrary to applicable local, national, and international laws and regulations, or that is contrary to the Duck Ruckus Community Guidelines which may be updated from time to time.
H. We don’t endorse or control what users submit.
Duck Ruckus does not endorse any User Contributions or any opinion, recommendation, or advice expressed therein, and Duck Ruckus expressly disclaims any and all liability in connection with User Contributions. User Contributions are made available “AS IS.” You understand and agree that when using Duck Ruckus, you will be exposed to User Contributions from a variety of sources and that Duck Ruckus is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Contributions. You further understand and agree that you may be exposed to User Contributions that are inaccurate, objectionable, offensive, or indecent, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Duck Ruckus with respect to User Contributions.
6. You must follow our rules when using Duck Ruckus, or we can prevent you from further use. See below for some specific rules for our users.
Duck Ruckus hereby grants you permission to access and make personal use of Duck Ruckus as set forth in these Terms of Service, but not to download or modify Duck Ruckus or any portion of Duck Ruckus except with express written consent, provided that:
A. Follow our rules and don’t break the law.
In connection with use of Duck Ruckus, you shall abide by these Terms of Service, the Duck Ruckus Privacy Policy incorporated herein by reference, the Duck Ruckus Community Guidelines incorporated herein by reference, and all applicable local, state, federal, and international laws and regulations, including but not limited to laws and regulations pertaining to libel, slander, defamation, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement. The violation of applicable laws and/or regulations may give rise to civil and/or criminal penalties.
B. How not to use Duck Ruckus:
i. Don’t slam our servers with “robots” or “spiders”.
You shall not use or launch any automated system, including without limitation “robots,” “spiders,” or “offline readers,” that accesses Duck Ruckus in a manner that sends more request messages to the Duck Ruckus servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser, except as expressly permitted by Duck Ruckus.
ii. Don’t systematically collect user data
You agree not to collect or harvest any personally identifiable information, including but not limited to account names, from Duck Ruckus. You may collect user data as needed for human interactions, in accordance with these Terms of Service.
iii. Don’t use our sites to prioritise commercial purposes
You agree not to use the communication systems provided by Duck Ruckus for any direct commercial solicitation purposes, instead focus on better stories and creativity.
C. Don’t make unauthorised changes to Duck Ruckus
You shall not alter or modify any parts of Duck Ruckus, including but not limited to Duck Ruckus’s website extensions or any of its related technologies, except as expressly permitted by Duck Ruckus.
D. Really, don’t use the web app for unauthorised commercial purposes:
You shall not use Duck Ruckus for any direct commercial purposes without the prior written authorisation of Duck Ruckus. Prohibited commercial uses include without limitation any of the following actions taken without Duck Ruckus’s express written approval: (i) sale of access to the Website or their related services, such as any website extensions; (ii) use of Duck Ruckus or their related services, such as any website extensions or APIs, for the primary purpose of gaining advertising or subscription revenue; (iii) the sale of advertising, on Duck Ruckus or any third-party website, targeted to the content of specific User Contributions or Duck Ruckus content; and (iv) any use of Duck Ruckus or APIs that Duck Ruckus finds, in its sole discretion, to use Duck Ruckus’s resources or User Contributions with the effect of competing with or displacing the market for Duck Ruckus, Duck Ruckus content, or its User Contributions.
E. Don’t make unauthorised copies of anything on the site
Whereas you may make copies of project pages for the intention of doing projects offline, you shall not engage in the use, copying, or distribution of any of the User Contributions other than expressly permitted herein. You shall not circumvent, disable, or otherwise interfere with security-related features of Duck Ruckus or features that prevent or restrict use or copying of any User Contributions or enforce limitations on use of Duck Ruckus or the User Contributions therein.
F. Don’t do anything else shady with or on our sites:
You shall not frame or utilise any framing techniques to enclose any trademark, logo, or other proprietary information (including but not limited to images, text, page layout, or forms) of Duck Ruckus without express written consent. You shall not use meta tags or any other hidden text utilising Duck Ruckus’s name or trademarks without express written consent. You shall not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any User Contributions.
G. You must abide by proper privacy practices.
You must establish and agree to maintain and adhere to privacy practices that comply with applicable state, federal, and international laws and regulations.
7. Prohibition Against Rogue Programming
You shall not upload, post, transmit, or otherwise make available in any way through Duck Ruckus any software or other materials that contain a computer virus, Trojan horse, bug, time bomb, worm, or other rogue programming (“Rogue Programming”). Duck Ruckus has no obligation to detect the presence of any Rogue Programming. Any download of software, files, or other materials or any other use of the content on Duck Ruckus is at your risk. You are advised to take adequate precautions to minimise any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.
8. You and Duck Ruckus are independent contractors. Duck Ruckus is not responsible for any issues you may have with merchants, traders, or any other users.
You and Duck Ruckus are independent contractors, and the Terms of Service are not intended to create, and do not create, any agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship between you and Duck Ruckus.
Duck Ruckus has developed a web app that enables residents to improve the quality of their lives through human interaction and creating, sharing and doing projects related to condiments. Interactions are between participants and not between Duck Ruckus and users. If you experience any issues or problems with a user of Duck Ruckus, you should address them with that particular user. Duck Ruckus is not responsible for any issues or problems you may have with other users or projects.
Duck Ruckus is not responsible if disputes arise between participants. When you use our services, you release Duck Ruckus from claims, damages, and demands of every kind — known or unknown, suspected or unsuspected, disclosed or undisclosed — related to disputes among other users.
9. Account Termination Policy
Duck Ruckus may terminate a user’s access to Duck Ruckus if the user is determined, in Duck Ruckus’s sole discretion, to have infringed these Terms of Service or the Duck Ruckus Community Guidelines. Duck Ruckus reserves the right to decide whether a User Submission is appropriate and complies with these Terms of Service for violations such as, but not limited to, pornographic, obscene, or defamatory material. Duck Ruckus may remove such User Contributions and/or terminate a user’s access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion. Accounts and the personal information we possess about you will be deleted in accordance with our Privacy Policy. If you have had your account terminated for cause, you are not permitted to create a new account.
10. Duck Ruckus is based in Australia, with servers in the U.S.A and may not be usable in your country
Duck Ruckus are controlled and offered by Duck Ruckus from its facilities in Australia and the United States of America. Duck Ruckus makes no representations that Duck Ruckus is appropriate or available for use in other locations. Those who access or use Duck Ruckus from other jurisdictions do so at their own volition and are responsible for compliance with local law.
11. Digital Millennium Copyright Act
A. Think there is infringing content on Duck Ruckus or was your content improperly removed because of an infringement report?
If you are a copyright owner or an agent thereof and believe that any user submission or other content infringes upon your copyrights, please contact Duck Ruckus.
12. We disclaim any warranties. Your use of our websites and our content is at your own risk.
You agree to assume all responsibility and risk for your use of Duck Ruckus and our content. To the fullest extent permissible under applicable law, neither Duck Ruckus nor its related parties make any express or implied warranties or representations whatsoever with respect to Duck Ruckus or our content, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose, and all such warranties are expressly disclaimed. Neither Duck Ruckus nor any related parties endorse or make any representation or warranty with respect to the accuracy, quality, security, reliability, timeliness, or completeness of Duck Ruckus or our content or that Duck Ruckus or our content is non-defamatory, non-infringing or otherwise lawful. Neither Duck Ruckus nor any related parties warrant that the functions performed by Duck Ruckus or our content will be uninterrupted, timely, secure or error-free, or that defects in Duck Ruckus or our content will be corrected. Neither Duck Ruckus nor any related parties guarantee or warrant that any files that may be available for downloading will be free from infection by software viruses or other harmful computer code, files, or programs. Duck Ruckus and our content are provided on an “as is,” “where is,” “where available” and “as available” basis. You acknowledge that any reliance on or use of Duck Ruckus and our content is at your sole risk. To the fullest extent provided by law, we will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of Duck Ruckus, any downloads from Duck Ruckus, or any other of our services.
13. Our liability to you is limited. That means that if you suffer losses, we do not have to fully compensate you for them.
To the fullest extent provided by law, in no event will Duck Ruckus or any related party be liable to any person or entity for any indirect, special, punitive, incidental or consequential damages or damages resulting from lost profits, lost data or business interruption, even if foreseeable, arising out of or in connection with Duck Ruckus’s Website, including, for example:
the use, inability to use, or the results of use of Duck Ruckus, any website linked to Duck Ruckus, or our content; loss, damage, corruption or recovery of data, or breach of data or system security; failure or downtime of Duck Ruckus, systems, or services in any way; hacking, viruses, malware, or other physical or digital intrusions into our systems, including, for example, those that result in a data breach; and our breach of the Terms of Service; in any case, whether based on warranty, contract, tort or any other legal theory and whether or not Duck Ruckus or a related party is aware of or of advised the possibility of such damages.
You specifically agree that Duck Ruckus will not be liable for any other user’s content or any conduct of a third party and that you assume the full risk of harm or damage from such content and conduct. However, such limitations will not apply in the event an arbitrator or court of competent jurisdiction issues a final, binding order finding that your damages were caused by Duck Ruckus’s wilful misconduct. This Section does not affect any liability that cannot be excluded or limited under applicable law.
14. Indemnification
A. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Duck Ruckus and its owners, operators, officers, directors, employees, affiliates, assigns, and agents, from and against any and all actions, claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including without limitation attorneys’ fees) arising from or in connection with: (i) your use of and access to Duck Ruckus; (ii) your violation of any term or provision of these Terms of Service; (iii) your failure to abide by applicable local, state, federal, and international law; (iv) your violation of any third party right, including without limitation any copyright, trademark, property, or privacy right; (v) any claim that one of your User Contributions caused damage to a third party; (vi) any breach of any representation, warranty, or agreement made by you in these Terms of Service; or (vii) your disclosure, use, storage, or processing of personal information in violation of any applicable state, federal, or international privacy laws. Duck Ruckus reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Duck Ruckus’s defence of such claim. In any case, you may not settle any third-party claim against us unless we consent to such settlement.
This defence and indemnification obligation survive these Terms of Service and your use of Duck Ruckus.
15. You agree that all claims between you and Duck Ruckus will be resolved through mandatory arbitration in Townsville, Queensland, Australia and not by a court or by a jury.
A. You will resolve claims with an arbitrator.
Any dispute or claim relating in any way to the Terms of Service, your or your authorised user’s relationship with Duck Ruckus, or your or your authorised user’s use of our services (collectively referred to as a “claim”) will be resolved exclusively by final and binding arbitration, rather than by a court or a jury. The only exception to such mandatory arbitration is that you are NOT prohibited from resolving any such dispute or claim as an individual claim in a small claims court. The exclusive venue for the arbitration shall be Townsville, Queensland, Australia.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the Terms of Service as a court would.
B. You are waiving your right to a jury trial.
If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. You acknowledge that you make this jury waiver knowingly, voluntarily, and willingly.
C. The fees and costs can be split in different ways.
Each party shall pay an equal share of the arbitrator(s)’ fees and costs relating to the arbitration, subject to the arbitrator(s)’ authority to reallocate such fees and costs in his or her discretion. In any event, each party shall be responsible for payment of their own attorney’s fees and legal costs.
D. Either of us can try to bring a temporary injunction against the other.
Either party may seek temporary injunctive relief in federal or state court in Townsville, Queensland, exclusively, at any time until the selection of the arbitrator(s) is completed. Once the selection of the arbitrator(s) is completed, the arbitrator(s) shall assume responsibility for any further action or rulings with respect to any such temporary injunction action. The parties consent to personal jurisdiction and venue in the federal and state courts of Townsville, Queensland, solely for the purpose of any such temporary injunction action.
E. You are waiving your right to bring a claim against us as part of a class-action lawsuit.
We each agree that any dispute, whether arbitrated or brought in small claims court, will be conducted only on an individual basis and not in a class, consolidated or representative action. Without limiting the generality of the preceding sentence, each party agrees to pursue its claims on an individual basis and not to (1) join its claims with any other person or entity’s claims, (2) pursue any claim as a representative of a class, as a private attorney general or in any representative capacity, or (3) participate in a class or collective action or mass action with respect to any claim. It is the express intent of the parties that the arbitrator, or, as applicable, small claims court, shall not have the power to award class or collective relief or to determine or order that the dispute should proceed as a class or collective action, whether in arbitration or in any other forum or venue. The parties understand and acknowledge that by entering into this provision, we each are waiving our respective rights to have a court or jury adjudicate our claims.
16. You can’t assign your rights under these Terms of Service, but we can.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Duck Ruckus without restriction.
17. These Terms of Service are governed by Queensland law and any claims will be dealt with in Queensland, Australia.
A. The laws of the State of Queensland govern all matters arising out of or relating to these Terms of Service, without giving effect to conflicts of law principles thereof.
B. In the instance that our agreement with you to use arbitration as set forth in Section 15 is not enforced, you submit to the exclusive jurisdiction of the state and federal courts of the State of Queensland for resolving any claim or dispute arising out of or relating to these Terms of Service.
18. Everything that you and Duck Ruckus have agreed on is contained in our Terms of Service and Privacy Policy.
These Terms of Service, together with the Duck Ruckus Privacy Policy incorporated herein by reference and the Duck Ruckus Community Guidelines incorporated herein by reference, constitute the entire agreement between you and Duck Ruckus with respect to Duck Ruckus, and supersede and replace any other agreement, document, correspondence, negotiation, conversation, or other written or oral understanding between you and Duck Ruckus with respect to the subject matter of this agreement.
19. Waiver
No waiver of any term of these Terms of Service will be deemed a further or continuing waiver of such term or any other term, and Duck Ruckus’s failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
20. If a court finds part of the Terms of Service invalid, it won’t invalidate the whole of the Terms of Service.
If any term or provision of these Terms of Service is held void, invalid, inoperative, or otherwise unenforceable by a court of competent jurisdiction, then no other term or provision will be consequently affected, and the remaining terms and provisions will remain in full force and effect.
21. General
A. This caption, and all others, are not part of the Terms of Service
The captions contained herein are for reference purposes only and are not part of this agreement.
B. We don’t have to keep the web app up
Duck Ruckus reserves the right to discontinue any aspect of Duck Ruckus at any time.
C. All other rights reserved
Duck Ruckus reserves all rights not expressly granted herein.
D. Certain parts of the Terms of Service will apply after termination.
Those provisions of the Terms of Service that expressly or by their nature survive will continue in full force and effect even if you stop using our services or if you terminate your account. For example, we will still have rights under these Terms of Service to any User Contributions. Also, everything that you have represented to us in the Terms of Service will survive indefinitely.
Privacy Policy
A. Our privacy policy helps you understand what we do with your information.
We collect personal information from you as you use Duck Ruckus.
Our privacy policy applies to Duck Ruckus, whether you access the service through a web browser, a mobile app, or another way. Our privacy policy does NOT apply to information collected on you by someone else. In those cases, you should consult that person’s privacy policy.
B. Our privacy policy is part of an agreement between you and us.
Our privacy policy and our Terms of Service apply to you, our “users“, as part of a contract that allows you to browse our website, do projects, collaborate, contribute and interact with others.
Keep in mind that Duck Ruckus is a software provider. We do not represent any Duck Ruckus users. Rather, we develop an online meeting place for those people to share, trade, and learn. We cannot control how other users handle your information. Please be careful when providing your information to other users.
C. Our privacy policy can change from time to time.
When we make changes to our privacy policy, your use of our services after we update our privacy policy means that you accept and agree to the changes, so please check this page occasionally to make sure that you are up to date.
2. What is personal information?
In basic terms, “personal information” means information that can directly or indirectly identify you, such as your name, contact information, and in some cases, information about your behaviour.
“Personal information” does NOT include information that we have made anonymous so that it can no longer be used to identify you. We collect anonymised data from our users for internal statistical purposes and for providing our services.
3. What kind of personal information are you collecting on me?
We collect information from you in three ways:

Generally, if you delete your account, we will continue to store your personal information for a short time in case of any issues, and then we will delete it in accordance with our standard procedures and applicable law. However, for security purposes, we continue to store your technical data for up to eighteen (18) months after your account deletion.
Generally, if you delete your account, your user contributions will be removed in the same manner as your personal information. When we need to for legal or security reasons
We may have to share your information with the police, the government, a court, or another person as required by law. Similarly, as allowed by applicable law, we may share your information with third parties as needed to:

- Statements that abuse, harass, mock, insult, stalk, demean, threaten, or otherwise belittle another user, directly or indirectly, explicitly or implicitly, even if the other user started it, and even if you think the other user deserves it.
- Providing personal information about any person for malevolent purposes (aka “doxxing”), including libel, slander, defamation, or harassment.
We reserve the right to immediately terminate or suspend anyone who fails to abide by our rules. The decision to suspend or terminate accounts will be made at the sole discretion of the site administrators. All account terminations are to be considered final.
